    Default Cosigner's Liability in a FTA Case

    My question involves criminal law for the state of: Illinois



    Hello I was trying to find out information about what happens to the co-signer if the person they bond out of jail never shows up to court? There are no bondsman in the state of Illinois so can i be charged with anything if my friend fails to appear at his courtdate or will they just forfeit my bond money?
    Also i was wondering if the FTA charge would be a misdemeanor or a felony if the original charge for the court date was for a class 4 felony violation of probation. I live out of state so i dont know if that changes anything ive said. thx.

    If the person doesn't appear, the bond becomes forfeit. If you posted a 10% bond, you could be on the hook to pay the other 90%.

    Your criminal friend should talk to his lawyer about the consequences of failure to appear, and what additional charges could result. We don't know anything about his case.
