    Question What are an Unmarried Teen Mother's Rights

    My question involves a child custody case from the State of: Virginia
    My daughter is a 15 (almost 16) year old. She had a daughter and has been taking care of her and going to school. They both live with me and my other two daughters. The baby is developing wonderfully. We have a court date that they said I had to be the petitioner in because of her age. The baby's father is claiming he is not the father so they have given him a guardian ad lit um. We received another court document about paternity. I assume they will establish paternity. He has repeatedly said he doesn't want to help with her because he has other things to do. Can he sign over his rights to custody? Should she have been assigned a guardian ad litum like the baby and the father have been?

    If he didn't want to be financially attached to a child for the next 20 years, he should have paid more attention in biology.... or to his attorney.

    If paternity is established, I recommend your daughter file for child support immediately.

    You cannot make him a father... but you can put him on the hook for support.

    Concur with Cyjeff.

    He can say he has other things to do all he wants. When the DNA comes back matching him with the child, he's the Daddy, and that entitles your daughter to drag him into court and have child support calculated.

    I promise you, the judge won't care about the other things he thinks he needs to be doing, he won't get to "sign over his rights". Quite the opposite - the judge will ensure his right to support the child he helped create will be enforced once your daughter files.

    The good folks at Trojan gave us condoms for a reason. If he couldn't be arsed to use them...well, you reap what you sow. So to speak.

    It's likely that your daughter was not assigned a guardian ad litem because she's already got a decent and responsible adult clearly looking out for her best interests.
