My question involves estate proceedings in the state of: California
My father recently passed away. He has no wife and left behind my sister, 17yo, and myself, 27yo. His will has never been found. The only property he had when he died were 2 vehicles: my sister's car (~7.5k) and my truck (~3k) I lent him to drive (both registered in his name for insurance purposes). He had no job, owned no home, no stocks/bonds, no life insurance, no retirement plan. His estate is not in probate. There was just the checking/savings account (only ~$150) and the vehicles. After his death, I found out he owed ~$30k in credit cards and now ~$250k in medical bills. I just received a LOI to Suspend the licenses of the vehicles since they no longer have auto insurance. My sister already transferred the car into her guardian's name. I found out how to Transfer a Vehicle without Probate but can I do so without the creditors suing me? What is the chance that they would even come after me for the value of the truck?
Thank you for any help that you can offer. I'm at a loss at what to do!
