    Default Passport for a Child

    Sorry if this is in the worn place but wasnt sure where to post it.

    I am british citizen, my hubby USC, our sons are dual they hold british passport and my oldest has US passport.

    We have applied for a US passport for my youngest son but it still isnt back, after contacting the passport agency they arent sure whether or not it will be back.

    We are moving to the UK leaving march 20th.

    We have been told that he cannot fly on the UK passport out of america by the passport agency, he will be refused a flight, he is 3.

    IS there a law stating he can only leave the USA on a US passport?

    I understand returning into the US on the US passport but not to be able to leave!!!!.

    Also now the ESTA has came about how will that work for me? I am a green card holder but returning to my home country. Should i surrender the card, even though we will continue to file joint taxes and stuff or if i want to re enter the USA to visit family here can i use the green card, its still dated till 2016.

    I have found no such thing.

    And if you think about it, it makes no sense anyway. If the only way you could fly out of the US is with a US passport, then US passports would have to be issued to every international traveler so they could go back home. Um?

    He should be fine to fly with his UK passport, being that he holds UK citizenship. Call the National Passport Information Center to double check.

    As for your Green Card, are you planning to abandon your US residency altogether? Is the move to the UK permanent? If so, you need to surrender your green card. You might find the information here helpful.

    Hi thanks for the response

    It was the national passport information centre that said he will be refused travel seen as he is a US citizen without a US passport. Even though we explianed it is a one way move, and he has his UK passport. We asked what law there is for such a thing and all she could do is point us in the direction of the US travel government passport site.

    May we add we paid for expedited service and its still not processed, llet along in the tracking system, its its ben 3 weeks.
