    Question Workplace is Making Me Ill

    My question involves labor and employment law for the state of: Texas

    I just found out that there has been mold in the workplace. Now I just started for this company in Nov of last year and in late January, I started having problems with what at the time was thought as just a Sinus/asthma problem to go into Asthmatic Bronchitis to just recently being back in the doctors office telling me that she thinks it is due to my allergies. Now this has been so bad that I have had to be on daily breathing treatments along with my daily medications for my asthma. I have had asthma for years and have had it pretty much under control as long as I stay away from my triggers. I have been tested to find out what triggers the asthma attacks and found that I am HIGHLY allergic to mold and have been told to stay away from it. And now that they have found that there has been mold in the building is there something I can do to get either my employer or the building owner to pay for my medical bills and possibly my time off which just the medical bills alone are near 1000.00 due to not having any medical insurance. And a total of 9 days off. They are looking to have this cleaned up some time this week, I am a little worried about going back in the building to only have to deal with this again before they get the building cleaned up. And once they start the cleanup process I know I can not be in the building. I am just wondering what recourse do I have????

    Have you asked about filing a workers comp claim?

    NO I havent yet. I just didnt even know how to go about this yet. Does workmanscomp pay for a couple of days here and a couple of days there? Do they pay for past issues?

    You'll have to discuss that with the claims adjuster. But if you are claiming this as a work related illness that you want your employer to pay for, the way to do it is through a workers comp claim.
