    Default Admissability of Polygraph Results in Administrative Law Hearings

    My question involves labor and employment law for the state of: Federal-US Department of Transportation

    What is the admissability of polygraph results in "administrative law" hearings (US Department of Transportation) in the absence of two-party stipulation?

    In the absence of such, ZERO, or pretty close. I am of course equating such with a criminal court proceeding for comparison.

    I believe at one time it was up to the discretion of the administrative law judge.


    Can anyone else shed some light?

    I am reporting a "service agent" for fraud involved in the performance of "random drug testing". The service agent is hired by a transportation firm governed by the US Department of Transportation Title 49

    Daubert basically deals with credible evidence. Polygraphs, by a general legal concensus, ase not reliable and scientific to much degree at all.

    This is one reason why Congress outlawed them, for the most part, for pre employment and post employment screening, exceptions apply of course.
