    Default Adoption and Child Custody in New York

    My daughter's biological father is not on her birthcertificate (he kicked us out when i was 6 months pregnant).. however he claims to want to have himself put on her birth certificate (as of yet he has not), and change her last name to his... my fiance and i would like for the 3 of us to be a family, and her father has blatently refused to allow him to adopt her.. is there a limit of time for him to claim to be the father before my fiance/husband can legally adopt her with out her biological fathers concent? her biological father has never seen her at any point in her life.. he seems to be all talk and no action

    Default Time limit for paternity

    There's no time limit to apply for paternity; at least, not during the child's minority. However, given a sufficient period of nonsupport and noncontact, a court may well be willing to terminate his parental rights within the context of a step-parent adoption petition on the grounds of abandonment.
