    Unhappy Changing Child's Last Name From Biological Father's Name to Stepfather's Last Name

    My question involves name change laws in the State of: Texas

    A little over 4 years ago I was lucky enough to excape from a very dangerous relationship at the time I was 2 months pregnant. When I was about 5 months pregnant I recieved a phone call stating that my ex-boyfriend had been arrested for stabbing a man to death. I was single, poor, pregnant and on medicade my case worker told me that it would be best to give my son my ex's last name so that it would be easier to put him on child support when and if he ever got out of jail. Long story short he was convicted sentenced to 30 years to life without option of parol. He refused to sign the acknowledgement of paternity so to this day my son has no name on his birth certificate but carries this murders last name. As for me I married my best friend who has been changing diapers, cleaning noses, and rocking that little boy to sleep since he was 2 weeks old my son doesn't even know that his father is really his step father so you could imagine how this could affect him one day we will tell him the truth but for now he is too little to understand. If my husband signs the acknowledgement of paternity can we have the other name removed. Please help us what can we do!

    You can get your husband to adopt the child.

    I recommend against knowingly falsifying legal documents. What you are trying to do is commonly referred to as a "back door" adoption, and it is the wrong way to go about it.

    For what it is worth... 4 years old is old enough to start having age appropriate talks...

    As the step father to one child and the father to another, I can assure you that there is no long term damage done when a child learns that they were chosen rather than born of the people that love them.

    Kids care about love... not biology. That doesn't excuse you from telling the truth, though.
