    Default Harassed Over A Debt That Was Paid

    In 1999 I was going to rent a room from someone. I left a deposit, but decided not to take the room. I let the owner keep my deposit. He sued me for 2 months rent, for painting the room pink, which I did not request and for another ad in the newspaper. The first judge awarded him everything, I appealed, the second judge ordered the amount that I had already paid. Keep in mine, I never lived there for one minuted and there was no lease agreement of any kind signed.

    The landlord decided to turn this over to collections, because he felt he deserved more money. Since then, the collection company placed a levy on my account. I appealed, went to court, they did not and they were STILL granted $497.90!

    They inquire on my credit about once a month, send false court letters to my house and they even send "rebate" checks (in the name of a false company) in hopes that I will cash them so they can obtain my bank account information. They have recently threatened to take my car (which is not paid off) to auction it off.

    The only reason this continues is because I am not familiar enough with the laws to stop it. How can I stop them from levying my bank account or taking my vehicle?

    I have filed a complaint with the BBB, they have a D rating, go figure. Is there anywhere else that I can file a complaint?

    Default Collection of Judgment

    If a court has approved the amount they are trying to collect, why wouldn't they be entitled to continue to try to collect it? Since it is a judgment you should be able to pay off the balance through the court rather than through the collection agency to resolve the debt and get them to go away.

    The court did issue them the amount of the judgement, they are still trying to collect more.

    Then try to pay off the judgment through the court.

    Well, according to the court, the case is closed. When they placed the levy on my bank account, they took the debt at that time.

    I guess I don't understand your description of the situation. If they know the debt has been satisfied, what are they trying to collect, and why is the court giving them orders permitting them to collect?

    That is my point. The debt has been paid, but they just do what they want and seem to win all the time. Like I mentioned before, they placed a levy, I went to court, they didn't and they still won, a debt that should never have been collected to begin with. They just claim that I owe them money and they keep getting it!?!

    If the court is permitting additional recoveries, then something hasn't been resolved. Perhaps they were awarded costs and attorney fees in association with their prior collection efforts. Perhaps if you have the case file reviewed by a local lawyer (or even a law-savvy friend) you can figure out what is going on.
