    Question Where Do I File

    My question involves a roommate in the State of: Colorado. She and I signed an eleven month lease, that ends in May of this year. She informed me of her decision to move out in November, and said that she would try and find someone to take over her part of the lease, and if she couldn't, then she would keep paying her rent. In January, she sent me a check for a small portion of the rent, with a letter saying that she was not going to pay anymore. She now owes for January, February, March, and some back utilities from when she still lived in the apartment. If I take this to small claims court, I should have a reasonable chance of getting a judgment against her, right? She is on the lease, and is liable until she is off of it, or until it ends?

    Also, she lives two hours away from me now, so do I file in the county where she lives? Or, since the lease was signed here in Larimer country, can I file here?

    How has your own search for a replacement roommate been going? What did you do to mitigate your damages?

    Sure, of course, you're free to sue her in small claims court and argue to the judge that she owes you money. Presumably it's more convenient to you to sue where you live; and that's presumably also where the contract was entered and breach occurred.
