    Default Visitation with Absent Father

    My question involves a child custody case from the State of: CA

    I am the custodial parent of a 12 year old boy. I have full legal custody no joint or anything of that sort and court order for supervised visitation and there has only been 3 visits. My son has never seen his father b4. My son agreed to see his father at the site for only a few minutes because I made him. At the second visit the nc parent showed up late so the site cancelled the visit because my son told them that he wasnt planning on seeing him, and the third time he refused to see him again. Now my son has started acting up severely at school since the visits started. Now we are going to start therapeutic supervised visitation and he has already told me that he is going to refuse to see him there too. Can a child legally refuse to see his father and at what age can they go to court and let the judge know what they want? I cant controlled him, please help I dont know what to do.

    What exactly does your court order state regarding visitation?

    Is your son in therapy?
    If he is, talk to his therapist about how you can go about explaining to your son that a court has ordered visits, and you can end up in big trouble if you do not force him to go.

    Then speak to an attorney about the possibilty of filing for a modification of the order.

    BTW- in your last threads, you were moving to FL, have you now moved back to CA?

    I have tried to explain things to him in every way possible but he just don't care. He just tells me that he dont care and no one is going to make him.
    His teachers have tried to be understanding but his sudden behavior has gotten so bad at school that they are considering expelling him and I dont know what to do. My son has even threaten to run away from home.

    What can I do about this as far as the court goes and can I file something?
    No I didn't move back to CA.

    My first question still remains how old does a child has to be to be able to talk to a judge regarding his feeling about this?

    You REALLY need to get your son into therapy right away. That should be done first because it can help your son understand, and it can also be a way for you to prove in court that your son is being harmed by the existing situation.

    So, first, get son into counseling, then get a consult with an attorney.
