    Default Wife Just Arrived

    My wife just arrived in-country on 18 Feb 09 - we just received the green card, which is conditional for two years. We have been married for over two years (16 Nov 96) - It was our understanding that we would not have the conditional because we've already been married greater than two years.

    Do we have to file/pay for the removal, or can we argue that we should be unconditional since the 2year condition was already met upon entry?

    If it wasn't explained in correspondence you received, try contacting the USCIS to try to determine how and why this occurred. From what you say, I wouldn't have expected the Green Card to be conditional, but I have no opportunity to review your applications or any correspondence you've received.
