    Default Giving Rights to Grandparents In Case of Death or Incapacity

    My question involves grandparents rights in the State of: wv

    The father of my 4 kids died back in '04. Before he died my parents bought the majority of Christmas presants and clothing and have regular visits. After he died they continued to do such and even more. My state has no Grandparents rights but I would like to have something legally (and I know this is not the correct term) co parents of sorts. As in if I'm ever injured, go insane, become incompatent, become a drug addict, die etc ... they go directly to my parents. No questions asked because they would already have some type of "custody" situation. For example if I were to be unconcious for a length of time they could enroll them in a school, get treatment for them medically things like that. Or if they felt I was unfit they could just come and take the kids from me like the state could in the same situation. Or even if there was a situation at the present school my parents could step in and handle it. With or with out me knowing. Is there any legal way to ensure they have this right (beyond a will) I hope these things never happen but you just never know and I want to make sure if something would happen my parents have 100% strong legal rights.

    Who else might try to take custody?

    If the parents designate preferred guardians for their minor children in their will, the court usually goes along with that designation.

    If I were dead I don't think anyone else would contest it however I'm more conserned what would happen if I was alive but unconcious, or something along those lines. Or if something happens to one of my kids and I'm not thinking clearly one of my parents who are really calm cool and collective people could be consulted and take care of it. Also if my parents take my kids for the summer and something happens they can take care of it.
