Default Legally Establishing Custody Across States

My question involves a child custody case from the State of: IL and FL

My ex and I were never married, we were living together when we had our daughter. She was just turned 2 when he went to FL for training to try to begin a new career. We were already considering ourselves "not together". After a few months he really liked it there and wanted to stay, and wanted to share our daughter. 6 months here and there worked for, so far, 2 years. She starts school this coming year, it's my turn next month to get her. Although we've said we wouldn't involve the courts and we would always try to work things out, he doesn't see that (as far as school goes) 6 months here and there does not work.

I want her in school here. Both of our families are here, the schools are better here, and honestly I really miss her. I don't want to ask for child support, and I'm willing to pay for her to visits to him, whatever.

Can I get a lawyer when she gets here (the way I see it, I realize that I took her down there on a plane and left her with him, so I wouldn't have room to do anything until he does the same anyway) and have a good chance at having custody of her for school?

You really should go ahead and file for the court orders.
