    Default Shoplifting in Nebraska

    First off I feel like a total and utter incompetent scum bag.

    --I was caught at Kohl's yesterday for shoplifting at 2:00 P.M. The amount that was stolen was around $100 (I am an idiot). I don't have a criminal record (besides a few speeding tickets, that was paid and taken care of with Stop class). I am also 21. Living in Nebraska.

    1) Kohl's said they will send me a bill; how much will that be and should I have a lawyer to dispute the amount?
    2) The police came and wrote me a citation. He gave me a pink slip about a Diversion program and a yellow paper with my court date. He told me that the diversion program IF registered before the court date can avoid me from going to court. Is this true? Should i double check? (I don't want a warrant out for my arrest because of a misunderstanding).
    3) Right after the incident; i drove straight to the diversion office and paid 60 dollars for registration; and a list of volunteering opportunities. ( I had 60 dollars for a diversion program; and I choose to steal instead of buying without consequences......i really hate my decision).
    4) If I did the diversion program; how will it look on my record? I should have thought about this before the shoplifting..but i made a bad decision and now i am facing every consequence. I just want to know.
    5) I am planing to move to TX this summer; how would it look when I apply for jobs over there?
    6) What can a Diversion program really do for you?

    1) You don't get to dispute the amount of a civil demand. You get to pay it, period. A civil demand is allowed by law, one of the many penalties you'll pay for your inability to keep your mitts off things that don't belong to you. Amounts vary. You'll just have to wait for the postman.

    2) You say later that you registered. Did you ask then? Contact the Clerk of Courts to check, but yes, this is usually true.

    4) If you successfully complete the Diversion program, you might not even HAVE a record. Most diversion programs keep the charge off your record, provided you complete them successfully.

    Thank you for the response. Yes, I did ask them if I have to go to court. The receptionist and the cop said I have from the day of the incident up until 5 days before court do i have to register in person. I did it immediately. Yet, when i read the forums here..it seems like everyone went to court instead..and then did a diversion program? I was just very confused about it.....

    The cop said " I don't know, but you might get a misdemeanor errr or something urrr i'm urr not urrrr sure..just call the damn number". Which i can understand his frustration towards me......I was polite; i cooperated with the whole situation......It was a bad decision..there is no if and buts....I did what i did...and I am owning up to all consequences....It was just really hard to ask for information without 1) getting an attitude back 2) not getting the right information asked.

    My action was a very incompetent act..and it DOES not matter if i was a competent or an inept person. I did a stupid act; but i just wanted some information..and I didn't get any....and it's very worrisome and frightening and overbearing.......I HAVE LEARNED A HUGE LESSON...

    --I am looking forward to paying from 500-1000 in dispute; and my diversion program is another 180. I am stating my volunteer hours today; and a meeting with a diversion director in two weeks. I am doing everything as promptly and as accurately as possible.

    --I made a mistake; a BAD BAD decision THAT SHOULD HAVE NEVER BEEN made in the first place.

    I would wait on volunteer hours.

    There is nothing that says a judge has to take previous volunteer services against your sentence.

    If you want to volunteer because it is good for your soul, fine.

    As to your question as to whether or not employers will see it... you will not finalize the diversion until you complete all of the court ordered parameters of your probation within the time line laid out by the court.

    Until that time, your offense can show up.

    --I don't expect a judge to look at my volunteering record or ANY of my record to lower any of my consequences.
    --I am volunteering because my diversion program started on Monday...but My court date isn't until April....which I am getting mixed answers about showing up to my hearing.
    --I might have to call my diversion office again to make double sure I don't have to go to court........
    --I also understand that my record is not cleared til' i finish the program. I just wanted to know how it would look after I am done with my program.....

    --Thank you to those who read my post.....and for the few advices i have gotten.

    1) When I was cited by the cops (Monday afternoon); i was given a citation that stated my court date ( April 13 ). With that, i was handed a slip with some information about diversion.
    2) Right after the incident I went to the diversion office and registered immediately!!! (that same Monday afternoon). I started my volunteering on Wednesday (2 hours down, 22 more hours to go)

    --Turns out, I don't have to go to court because I chose to sign up with my diversion office instead. It was court or a diversion program.
    --Once I complete my program a background check could show up as a Misdemeanor completed with a diversion program...or it will not show up at all (THAT IS... IF I FINISH THE PROGRAM). Also; I was not convicted (because i will not go to court; i chose to do the diversion program instead) so in applying for jobs I can always check the no box on the applications.
    --I am waiting for a dispute letter from the store i shoplifted from. My spring break vacation money is going towards the dispute and my diversion program. Which I think will total up to 500-700???
    --I talked to my diversion mentor today; and my program ends in September, but If i stay in school; go to work and stay out of trouble my program can end a little earlier once I finish my volunteering hours.

    --All of this in a course of three days. I was not able to sleep because of the guilt. I wrote an apology letter to the LP at the store for their inconvenience (i sent it to the store; and i got their names when they were filling out the forms for me)...and I HAVE LEARNED A HUGE HUGE HUGE LESSON.
    --The stigma will always be there......and i won't be able to change what i have done....but I am trying..........
    --I believe that i am a total and utter complete idiot.

    Now i just gotta take it slow and start doing what i need to do...
