    Default Employer Won't Let Me See Hours of Availability

    My question involves employment and labor law for the state of: Wisconsin

    Tonight I asked my boss if I could view the spreadsheet for hours of availability. She said no, that she hasn't kept such a thing(I even reminded her that the previous manager showed me where the Excel file was kept on the computer) and that she has memorized the entire hours of availability, to use week in and week out to create our dynamic schedule(involving 15 employees, 7 days and two different shifts). Sooooo, she can not go a single week without forgetting to order something for the weekly stock, which results in something or another running out midweek, but she has an eidetic memory and has the hours of availability ingrained into her mind? She is afraid that I will take it and copy it, because she has been working me past my hours of availability every single week. I checked my state's BAR, and, just like I figured, the statute regarding requesting personnel information was as obtuse and undetailed as the night is long on Winter solstice.

    Is this something I can tell her will be made available to me as per state statute? In the past, any changes to it by an employee has been done with a physical sheet that is freshly reprinted every once in a while.

    No, there isn't any state statute that requires her to allow you to see the hours of availability spreadsheet. Or even that she have such a spreadsheet. The state statute covers records that are individual to you and you only, not information that she uses to determine scheduling or other planning. In fact, materials used for staff management planning are specifically EXcluded from the statute.
