    Default Alias Summons and Statute of Limitations

    My question involves collection proceedings in the State of: TN

    I have a credit card debt that was last paid on 07-2002. I was issued an alias summons in November of 08 with a court date in Jan of 09. I answered the summons with a Statute of Limitations defense since the state of TN only has 6 years. They have now came back and said that since it was an alias summons the original date of the filing in 07 made that defense not possible.

    Now I didn't know about this until getting the alias summons in 08. How could I have responded in 07 to the original if I never received it? How does this affect the SOL for TN and where does this leave me?
