    Default Custody of Daughter Living With Grandparents

    My daughter was born in Virgnia and her mother and I were not married. We moved to Tennessee when she was 2 weeks old. Her mother and I had many problems and she left with our daughter one weekend and returned to her parents house with my daughter and they would not let her leave with her because she was on drugs. She then had a wreck and was put in jail. On the condition that she sign over temporary custody, they got her out of jail. I had no idea that this had happened until months later when she and I split up. I attempted to get custody but was told my daughter had never been legitimized. I just found the paternity documents from Virginia. My daughter lives with her grandparents and the mother is out of the picture. What are my options legally now that I have found these documents?

    These paternity documents legitimize you as the child's father?

    What status do the grandparents have - that is, are they simply taking care of your daughter, or are they court-appointed guardians?

    They only have temporary custody and the conditions surrounding that are questionable as well. They let me see her whenever I want and recently let me bring her home for the weekend, so it`s not like a have a bad relationship with the grandparents.

    Is the granparents' status as temporary custodians the result of a court order?

    Yes, the doucument says I am her father. They got the judge to grant them temporary custody without my knowledge. I did not find out this had happened for several months when her mother and I split up.

    Default Custody Dispute

    As it would appear that you are legally recognized as the child's father, you should be able to bring a motion before the court which granted temporary custody to the grandparents, and ask that you be granted custody. It would be a good idea to consult a family lawyer to have your situation and the case history reviewed, so you can figure out the best tactics.
