    Default The Correct Way to Abandon Permanent Residency

    Good day, here is the story, thank you so much for your advice!

    I applied for the green card lottery in 98 and won the green card in 99 (I was 22 years young), the year I’ve entered the States. My green card is valid until next year. I don’t want to renew but to abandon permanent residency.

    The background: when I won the card, I was about to assume my studies in Great Britain, which in the made me absent for about 18 month. I went to the consulate in Frankfurt to get a reentry visa, but haven’t heard from them until six month later. Inbetween I had to travel for my job to Mexico, using the chance to enter the US in Minneapolis after the conference. Which caused problems, but eventually I received the “entry permitted” stamp, my passport and my GC back. Back home, I received a letter that the reentry visa had been denied. Nothing more. I ignored/forgot about the letter, as I already traveled back and forth then without problems.

    Which I did also for the past years, traveling without problems. I do have a social security number and filed tax until 2005. I would like to catch up on the missing tax files 2005/6/7/8 immediately. Fact is that I have never lived and/or worked in the US, because everytime I attempted, fate changed ways (fiancée split up, job not available, boyfriend had to go to war). So I sadly stayed in Germany, where I happily found my personal luck just recently. Last time I entered the States was in December 2009, without a problem.

    What is in your opinion the best, cleanest and safest way to abandon permanent residency, to still be able to enter the US as a tourist? Is there any help for people living abroad (vecta doesn’t seem to exist anymore) filing taxes? I am very desperate to get this mess solved. Unfortunately I don’t have enough money for an attorney.     Hi Maja,

    If you're absolutely, positively, 100% certain, no regrets that you're willing to abandon your LPR status, you need only complete form I-407.

    Your status will then revert to non-immigrant, no harm, no foul, and no effects on your future travel into the US as a tourist.

    Since you eventually re-entered without trouble, I wouldn't worry too much about the letter.

    With respect to the taxes, since you've not worked in the US, you don't owe any income taxes and need not file.

    well, it was a lot of trouble, but worked out finally at this time.

    sorry to contradict concerning the taxes, but as a permanent resident, even living abroad with only foreign income, you need to at least file 1040 an 2555-EZ every year. if you fail to do so, you cannot maintain your status as a permanent resident.

    as to the form which changes you status: which last address in the US would you suggest? i never changed the address, which has been stated to receive the card and my to obtain my ssn.
