    Default Car Impounded to Pay Old Tickets

    Here is the situation:

    I have had various problems with my liscense to drive from when i was younger (20), i am now 34 and just spent several thousand dollars to correct my liscense. I purchased a used car and after 2 months NYS claims i owe and additional $1200 from 8 years ago. So they towed my car at 5;00am when i was about to leave for work. Now add towing fees and ($350) and $15 per day storage until i can afford to pay them. They have also only given me 14 days to retrieve my car and it is up for sale this monday the 4/11/05. Is it legal to give me such a short time to get my car?

    I am a poor single parent and dont know what to do about this and desperately need advice. I now take the bus and walk to work wich adds two hours each way to my communt, i dont care about that, i just wanna know what the finance company will do to me since i dont have the car and cant offord to pay them. (my monthly commute is almost as expensive as my car payment) I am scared they i will go to jail and my 4 year old son may be put in foster care or something. Any help on what i can do will be appriciated, i have little time left.

    also, will bankrupcy help me in any way?? Unfortunately i have to choose between paying my rent or whatever consequences i may incur by losing the vehicle and not being able to afford it.

    if anyone has any information for me it will be greatl apriciated. thank you for your help in advance.

    Your finance company should have a lien registered for the car. If the car is sold, they should be paid out of the initial proceeds, with any balance applied to the impound fees and old tickets, and any surplus paid to you.

    Quite possibly, yes. It may well be that you could get some or all of the old court assessments the impound fees discharged in bankruptcy. Also if you file in advance of the sale, the "automatic stay" would prevent sale of the car until either the court grants permission for the sale or the bankruptcy proceeding is concluded. You should discuss your situation with a bankruptcy lawyer to see if it is an appropriate option given your debt load and circumstances.
