My question involves a background check in the State of: Massachusetts
(actually, the company in question is in MA, I live in NJ, the company requesting the background check is in CA, and company processing background check is in SD, not sure if any of that matters)
I recently accepted an offer from a company who requested I consent to a background check, which I did. I checked the box on the consent form to receive a free copy of the report. I noticed that one of my prior employers gave out my salary to the background check company. I never disclosed my salary on the consent form or to the company requesting the background check.
Is it legal for a prior employer to give out your salary information without your consent? As noted on the background check, all of the other employers they checked with declined to give out salary information.
