    Default Accomplice Liability

    My question involves criminal law for the state of: PA


    Alright so i went with a friend which said we're going to see his cousin. We get to the city and hes here buying a quarter lb of weed and it turns out he was under investigation for a little while and it was a setup. We were arrested and I was charged with purchase of a controlled substance. My friend said in his statement i had no knowledge of this buy as i did in my statement.
    I am already on probation (ard)for paraphernalia and i feel helpless, can they really go through with this charge? Just being present enough to charge me? I have a public defender due to my lack of money is this a good idea or should i take a small loan out for a real lawyer? Will i sit in jail?

    expect your probation to be revoked. At some point, you did become aware of the intent of the trip. At that time, you made the decision to continue or leave. You continued.

    Alright i understand that point but couldn't my attorney claim it was raining/late/big city that i don't know, which are all true. Or will that never hold up in court? And will i see jail time out of this?

    your attorney can claim whatever s/he wants. Its up to the courts to accept it or not. If you were aware of it being a drug deal, I don;t think rain/late/big city are enough to cause them to ignore you were aware of the situation and still continued. After all, a drug deal is often more unsafe than a big city itself or rain and yet you still attended the drug deal.

    as to jail time; it's up to the courts. You could have your prob revoked and have to serve the time for your previous crime PLUS time for this crime. Who knows? Nobody actually except for the judge.
