My question involves real estate located in the State of NC. our new neighbor has decided to sell the rental beside us. He had the property surveyed and shortly after his rentor ran over one of the stakes. I let the property owner know the stake needed to be replaced but he never did anything about it. Their were three stakes...two in back and one in the front yard. The two in the back were actually for showing where his property line is and where our other neighbors is.The one that got destroyed was for the nextdoor neighbors property line that fell in line with the stake placed in the front yard. I noticed the trees in the front yard by the one foot wide strip of his property and thought it was odd that he might be planting a tree and bush on a one foot wide strip...figuring he had just set the tree and bush there randomly. Well, our neighbor conveniently forgot that his property stake was destroyed in the back and decided to plant trees on our property. We told him he was on our property and that he needed to remove the trees plus get the surveyor out there again to fix the stake. He acted ignorant of this and flew off the handle. After he pulled the trees up I checked the stake in the front yard and low and behold he had MOVED the metal stake over about 5 inches or so and planted the tree in our front yard. My understanding is that it is illegal to move surveyor stakes. I would like to report this but have no idea of who to report him to...any ideas? Thanks a bunch! Also, I've been trying to find out if there is a setback ordinance for trees and fences and such but have gotten no where with the local government.
