    Default Traveling with a K-3 Visa

    Dear all,

    Our I-130 and I-129F petitions just got approved. We expect to have my husband's K-3 visa in a few months. I am from Texas. Now it looks like I might be taking a job in another country this fall for two years (not where my husband is from), and of course I want him to come with me. I know that one can travel with a K-3, but what about living outside of the US for 10 months out of the year? Is there any limit on how long you can be gone? How would this effect his application for a green card?

    As the State Department explains,
    Quote Quoting Can I travel and re-enter the U.S. on my K-3 or K-4 visa?
    Aliens present in the United States in a K-3 or K-4 nonimmigrant visa status can travel outside of the United States and return using their K-3/K-4 visa. If they have filed for adjustment of status in the U.S. prior to departure from the U.S., USCIS will not presume that the departure constitutes abandonment of an adjustment application.
