    Default Can I Emancipate My Child in New Jersey

    I live in NJ and my child is 20 yrs old, I am still paying child support $112 a week. I have 3 other childerns from another marriage which were never calculated in the original child support order. my son as far as I know attends college full time. me keep paying that money is a real hardsip on me and my family. I have not seen my child for over 10 yrs and him and his mother refused to deal with me or may family. can i get the child support stoped? and if I go back to court do you think the judge will reduce or increase the support order. and until when will I keep on paying. I work 2 jobs and I make approx. $850 a week please help. thank you

    That is not emancipation. He is 20, and is already emancipated.

    I have very, very limited knowledge on this subject because of a situation with my brother in law. I am getting this third hand but if I understand my BIL's situation correctly, NJ is the only state in the US where you have to go back to court to apply to have child support stop; it does not cut off automatically. So yes, definitely go back to court. If your child is 20 years old I think it highly unlikely that the judge will increase it; much more likely that he will stop it altogether. Your child has been a legal adult for two years now.

    UNLESS, of course, the original child support order was to cover the child through college or until the age of 21.

    Some orders do include this provision.

    thank you all. i am not sure if the the original child support order was to cover the child through college or not....my understanding was if the child attends college i would keep paying until he is done or until age 25 is that true? or as you said ABG the support will not stop till i go back to court. if any one has any additional info. please pass it on, i trully appriciate U ALL

    I have no idea what your support order says. If it says until the child is through college you may not be able to get it stopped. If it says until age 25 you may nor may not be able to get it stopped. You may or may not be able to get it reduced in either situation.

    If it does not say that, then I would think you have a good chance of getting it stopped.

    Nothing is going to happen until you take action.
