    Default Background Checks Involving Possible Job Hire

    My question involves a background check in the State of: New York

    Here's the deal.

    I have applied for many bank positions, such as a Personal Banker, Teller etc...I have worked for New York Life in NYC, And various other large companies. I do have experience in management and other related fields. So, naturally I figured I would be a perfect fit.

    My main question's in regard to job related backround checks are:

    1.) When I was 14 I had a criminal conviction in the form of a misdemenor for possession of a Pellet gun in school. I was given two months probation.

    The story:
    Specific detail on the case was: A friend had taken the bb gun from my home and I had later discovered it was him when the gun was no longer in its holding box. I consulted my mother to drive me to his home in which to retrieve the gun. She declined stating the distance was to far for her liking, 10-15 minute drive. Never the less there was no absolute way to retrieve the $150.00 gun I was so eager to return to the sporting goods store. So I suggested to him bringing it to school to retrieve it. I really had no use for this and wanted no part of the expenses. When I was on the school bus a "friend" who had wind of the situation was speaking to loud and a younger school mate over heard and further had asked question in regard to the truth. She had never liked me as a schoolmate, so she had started to argue with me on the school bus in which she was ignored by myself. Furthermore, the other children on the bus had instigated the incident by telling her to get out of the back of the bus etc...She had become rebellious because of the other children's statements....

    In that case she had told the bus driver and the blatant outcome had occurred. Such things as police coming forth and arresting me after I gave various statements about what happened. After what had happened the girl stated I threatened her and the police brought me in for questioning that day. After one month of review and investigations the police ended up finding her story to be a false report due to eye witness's and various other assortments of reason. Her parents dropped the case after they were notified and the girl was verbally scalded by parents and other relevant people involved. She also left school and had no come back the following year.

    *The relevance of this story is to showcase the seriousness & non-seriousness that was explained to the police. To give the level of severity & intent. In which case I was issued 2 months probation to show some sort of punishment in which I called the PO twice and it was over.

    *I had not been in any sort of trouble since.

    2.) In september of 2008 I had to move in with my father because my mother had abandon me to live with her boyfriend. Both parents being disfunctional, my father had decided to put a restraining order on me because he realized the only way to kick me out of the house after 30 days of living there was taking me to landlord tenant court. This process was lengthy and very difficult to get one out in a quick time expectancy. usually 3-6 months.

    He got an idea from a friend to put a restraining order on me and he was going to the police station every other day. He'd call the police on me and they came yelling at him because of his agressive and non father like behavior. My father denied me food, and any sort of ammenity use of his home. I slept on a couch and the police saw the whole picture. My father would try to bribe me to pay rent or follow his rules when he never paid child support or supported me in anyway, he just constantly called my home for 10 years. So I had the opportunity to use him at my disposel. He threatened to tell the police I violated the temporary order if I did no follow his rules. I'm 20 years old now and at the time, I was working on a 81k a yr commision for a fortune 500 company, Lived in manhattan on my own until I wasn't making money anymore, So why would I listen to him when Im there to live not be in by 10 pm like he wanted. I was not making money due to the poor economy so i could live on my own anymore. Which made my life worse. Two weeks before the second court date, He punched me in the face because he had caught me using his salt and pepper for some some food, Telling me "I told you not to eat my food". I called the police on him and told them not to arrest him for his actions. The next day he went to the police station and said I "body bumped" him (which was self defense) and I came home from work in a suit and tie with a bible of financial papers and I was arrested by 15sheriffs for supposedly violating the order. When the order was obstructed for getting him off of me because of being pushed against the cabinets in the kitchen and then punched, wow. The judge did not even listen to my story and had told me to vacate or go to jail, I was homeless with no where to go in which he was aware of. I took the vacate offer.

    Then I moved in with my mother which is the same product as my father, crazy. But, unfortunately my only option...I attened another hearing after quiting my job because it was twice the distance away then going from my fathers house. The judge threw out my fathers case and said "after today there is no more case". He seemed to be able to judge the situation better than the previous judge. He saw the restraining order was just a scapegoat to vacate me etc.. The order of protection is good for up to a year because the previous judge did so.

    NOW my mother wants me to leave the house because she wants nothing to do with me for the same reasons. Which would be my distrupting her way of life. Hence not pay any sort of rent (which I can't), and bothering her when I need to go to the grocerie store or run errands. She declines because she is busy with the same boyfriend she moved in with and THEN moved out with because they had gotten into a fight AFTER I moved. Remember, im only 20 and went through all of this because of her.

    My mother tried playing this card before I moved out the first time around but did not succeed because I had friends as witness's in which they stated she was instigating me and had displayed domestic violence in their presence. So police did not insist on following through with any further action.

    NOW without anyone to back me up, she went in for the victory.

    She just put a temporary restraining order on me, same thing my father did. Which is for some odd reason good for one year. I have no idea why, but it is. Now I have court in two weeks for this order.

    Questions:

    -If I have a thorough backround check done on me from any employer will these past items show up?
    -Is this preventing me from getting a new job anywhere?

    After I worked for New York Life I had a position at Macy's as an Assistant Supervisor and was laid off due to not making the store not making goals, In which I was told if they were making store goals I would be able to stay aboard and become a store department manager.

    -Are they allowed to cover up the real reason?
    -Is it possible My contract was pre-maturely ended due to them doing a backround check which came up negative some months after I was hired?
    (I was also hired on the spot and had no idea of any check being done so immedate)

    -Also please give me feedback if my story has any sort of advantage to these past alligations and or convictions to lessen the seriousness of these actions to an employer, or would this not mean any difference?
    -Does an employer look at a title of offense and thats all?
    -Do I have to mention any of these related inncodents on application forms? interviews? etc..

    These are the only things that have happened to me, getting caught for the possesion of the pellet gun, with logical intent on my part. The two restraining orders by mother and father. I have never done drugs, or drank alchohal so there would be nothing pertaining to dwi's or any sort of drug charges.

    Not having charges as serious as I just stated..
    -Does that give me a better advantage of not being hired by a future employer?

    -I suppose my main question is, Where do I stand with my backround, is there anything substancial for an employer to decline me from a future job or career?

    That was nowhere near concise.

    We have no way of knowing what will turn up in a background check. If it's in your background, depending upon the nature and extent of the background check, there's a chance that it will show up. If it does show up, the question of how your employer will react depends upon the nature of the information detected and your employer's policies.

    As for whether something may have turned up in a background check, and may have been the "real reason" you were laid off? The only way you're getting an answer to that is from your former employer.

    If your history does show up on a background check, there is no way for us to know how any individual employer will handle the information.
