    Default How Do I Request a Different Judge

    My question involves child support in the State of: New York

    My son is 17, has decided he doesn't like my rules and went to live with his father. There are no rules there. Meanwhile I tried to tell the judge that it is not a good environment for my son, but they refuse to send him home, saying that he is old enough to decide where he wants to live. I kniw there are things going on there that are detrimental to my son's well being, nobody seems to want to listen to me. He is not doing well in school, in danger of not graduating, he is drinking (with his father) things of that nature. Clearly, my son is NOT capable of making the right decision, what 17 year old would choose rules over a free-for-all? His father will keep him there as long as possible for two reasons...to hurt me and because he gets ALOT of money from the state and from me. None of which goes to my son. The court system IS NOT working for my son. What do I do?

    Your son will soon be 18, at which time nobody can tell him where he can life. The court's decision reflects the reality that if your son chooses to ignore the court's order and run away from your home to stay with dad, nothing the court says or does will make him want to live with you or cooperate with the custody order.

    As hard as it is, the best choice in this type of situation is usually to let your kid make his mistakes, and hopefully learn from them.

    You can petition the court, asking the judge to recuse himself. Disagreeing with a judge's decision is not of itself a sufficient basis to obtain recusal.
