    Default 1st Degree Burglary

    My question involves criminal law for the state of: South Carolina

    My friend was charged with attempted 1st degree burglary at the start of january. This was his first time getting in trouble with the law. He is 21 so he is currently in jail. This all happend around midnight, he never went into the house, but tried to look through the window after knocking on the doors, so they have his one of his fingerprints on the window. He then left and was walking home, when the cops stopped him because there was apparently a person in the house who had called the cops. We are getting him a lawyer this week because his public deffender is only offering him to drop down to 2nd degree. We need him out because he has a baby due at the end of april. Will the lawyer be able to drop his charges down from felony charges and is there any way he will be out soon? His first court appearance, where he is supposed to get a bond, is in 2 weeks. this is all annoying! help plz!

    Anything is possible, but no one can predict what mood the prosecution might or might not be in when it comes to lesser pleas. Public defenders work many more criminal cases than private attorneys, know the judges and prosecutors on a first name basis, and if the PD believes that 2nd degree is the best the prosecution is willing to offer (based on lots of experience with them), I wouldn't get my hopes up that a different attorney will be able to produce more drastic results. But stranger things have happened, so I suppose it can't hurt to try. Just don't be surprised to get the same offer.

    His pending fatherhood is legally irrelevent to the charges at hand (people are supposed to think about such things BEFORE they act in ways that could put them in jail, remove them from their families, etc.).
