    Default When Can a Child Legally Drop Out in NYC

    My question involves education law in the State of: New York

    My daughter is currently 16 years old. She will turn 17 in exactly 1 month from now. Due to her poor grades and very poor attendance if she was to graduate she could not until 21.. and she will most likely age out anyways.
    I was reading the chancellors rules... published in 2000... its a bit old.
    Saying that once shes 17 if she misses 20 days ina row she will be discharged and also I cant sign her out unless the end of the school year..

    Is this accurate? When exactly can she leave without legal problems? As soon as shes legally 17 or the end of the school year??

    Confused mother asks... and now waits for a reply.

    New York's Education Law (Chapter 16 of the Consolidated Laws, Title IV, Article 65, Part I, Section 3205) says that minors between the ages of six and sixteen must attend school on a full time basis.

    If you turn sixteen during the school year you have to finish out the term before you can drop out.

    NYC may have an ordinance pertaining to school attendance, but in my quick searching I didn't see anything different from state law. You can always ask the school.

    If you're in fact mom and not kid, you really should get behind your kid's education. But you sound like a kid.
