    Default Filing for Divorce then Sitting on It

    My question involves divorce in the State of: Michigan

    I just found out that although my husband has filed for divorce (I even verified it with his attorney this morning), he has decided not to serve me with papers. He says that I am the one who wants to divorce, not him, and so the ball is in my court. I tried to go through Legal Services (since I'm low income) but they can't help me unless I'm living on my own or get served.

    Can you file for divorce then sit on it? Who the heck does that sort of thing? Why?? Is there anything I can do about it? I'm trying to find an attorney now, but unless I can find one willing to work with me on payment, I'm screwed.

    If no action is taken over a long enough time, the court will dismiss the case.

    If you want, file a counter-complaint for divorce. You can look for a state-specific self-help "how to handle your own divorce" book at a local bookstore (e.g., Borders or Barnes and Noble), or through an online store. That will save you filing fees, as he's already paid to file the case.
