My question involves criminal law for the state of: Montana.
Hello everyone, I have a growing problem on my hands that any extra advice could come in handy with.
A week ago last night, I walked out of a gas station to a man walking around my truck looking at my tires. I stopped to talk to him and he had told me that apparently 10 days beforehand his truck, same model as mine, had been stolen in the neighborhood, stripped, and ditched not too far away. He asked where i lived, and i gave him a general direction. He asked to look under my tonneau cover and i would not let him. I drove home and parked in the driveway of my apartment complex, and watched this man park outside my apartment until i left an hour or so later.
That saturday, me and a roomate switched rims and tires on the street outside my parents house, one i didnt want this guy bothering me, two i wanted higher profile tires. We finished, my friend left, and i was in and out of the garage working on my moms car and jumping on the computer. While i was inside, i saw three men walking around my truck with a video camera filming the tires and interior. I went into the garage, and the three men walked in, one of them was the same guy from the other night. He kept asking for my and my dads number, i told him to get the hell off my property and to call the cops if he thought i stole his truck.
That monday morning, i was awakened to two policemen knocking on the door. They took me and my friend outside, asked to look in the garage, i let them. The officer asked to look around my truck and at the interior, and i obliged, although i should have probably asked for a warrant. The officer went on to ask me different questions trying to get me to confess to stealing this mans truck. The officer had tried to tell me they found my fingerprints on truck parts found in my dumpster, i told him i knew nothing about that. The officer had asked if i had done any work to my truck lately, i said no. He also asked if i had always had those same seats in my truck, as this man was apparently describing them to a T. I said they had always been there, and those tires had been on it since i bought the truck. I let the officer take pictures of the seats as he had seen them anyway.
He had also told me that the mans daughter had heard rumors of me and my friend stealing this truck and parting it out. According to the officer they have video of both me and my buddy driving around the are the truck was ditched the night it was found.
He read me my Miranda rights and i told him i would rather talk to an attorney before answering any questions.
They went through the same runaround with my friend and his truck, however he would not let them search his vehicle, but he did let them question him. They showed him a video this man took of us switching out rims and tires outside my parents house. The officers left and said they would be back with a warrant to search my friends truck later.
We went to talk to a lawyer that afternoon. He said he didnt think that they had enough to press any charges.
A detective got ahold of my buddy wednesday afternoon, and had met with him yesterday afternoon for more questioning. They showed him photographs of a few parts and a seat in the back of his truck that matched parts on this truck that were stolen. The also showed him photographs of the ditched vehicle, and photographs of empty spraypaint cans in my dumpster that matched paint on the vehicle.
They bullied him around a bit, told him they didnt think he did it, trying to get a confession or a name out of him. They impounded his truck for the "stolen" tires being on it, and he had to walk home.
My question is, does this seem like enough evidence to convict either me or my friend? The officers had said they would be out our apartment today with a warrent, however both of us were at work at that time.
We talked to the lawyer again today, and he said as long as the previous owner states that those items were on my truck when i purchased it, we would be fine. I have no way of getting ahold of the previous owner.
Any help or advice is greatly appreciated, and the sooner the better. Thank you
