    Default Speeding Ticket California 22349 Using LIDAR

    My question involves a speeding ticket from the State of: California.
    Driving home from Tahoe on Labor Day with my wife and kids in the car along a well known downhill "speed trap" section on Hwy 80 near Colfax, I was pulled over and written up for driving 92 in a 65 (code 22349). In my (and my wife's) opinion I was driving 80-85. When I questioned his claim of 92, he said another cop clocked me using LIDAR. When I questioned how he knew it was me, he claimed the cop said "it was a white SUV in the far left lane." It was Labor Day, lots of traffic, and lots of white SUVs (most popular color) driving back from Tahoe. All I really want to do is go to traffic school but can't since it's 25 MPH over the posted speed. I have a court trial on Monday. Any advice? Thanks!

    Semi trucks are able to maintain their posted 55 MPH limit, even on the steep downgrades. Why can't an SUV maintain 65 MPH? It's an argument which will be shot down by the judge if that is an argument. Especially if you claim you were only 80-85 MPH.

    If the officer shows up, plead no contest at the beginning of trial and ask for traffic school up front. Most traffic courts honor that request. That is, if all you are looking for is the traffic school option.

    Thanks. I asked for traffic school at my initial court date but was denied by the judge...which is why I had to plead not guilty and ask for a trial. I agree that 80-85 is still too fast (which is why they pull over so many vehicles on that stretch), but traffic school should be an option for me.

    Update: my case was dismissed when only 1 of the 2 CHP officers showed up!
