    Default My Visitation

    My question involves a child custody case from the State of: texas

    I have Joint Conservatorship with my ex husband. He currently has primary. We lived in the same town til just about 1 month ago. I had my visitation on the 1st, 3rd and 5th weekend and even when i moved i continued with that schedule. Tonight my ex husband tells me that I only get 1 weekend a month with my kids. I read my decree and it clearly states that "UNLESS I ELECT TO CHANGE TO THE 1 WEEKEND, THEN I STILL HAVE MY EVERY WEEKEND. " What can I do if he does not show up for my visitation?

    If he does not show up, document it and file to enforce the court order. It might help if you fax him a copy of the order, reminding him of his responsibilty to obey the order.

    so criminally there is nothing that i can do at that point of time. So if does'nt show, I don;t get to see my kids?

    Criminally, no. Yes, if he does not show up, you won't get to see your children. However, when you eventually file a contempt motion (which is civil, not criminal) you can request make up visitation.

    Is it specifically written into your order that he bring the children to you?
    If it isn't, you can offer to go pick them up.
