    Default How To Be Emancipated

    My question involves emancipation laws for the State of: Florida

    I live in Florida and I am 17. My parents are moving to Michigan and I am staying behind to complete my senior year of high school (it was a mutual decision). I am going to live with some friends, the only problem is that i can't enroll myself in school because I am under age. I do not have a job, but I am looking for one, and was wondering if I could get emancipated pretty easily or if it would be a long drawn out process.

    Your parents will have to file the petition for you; that is the law in Florida. No parental filing, no emancipation. If they will do that, how long a process it will be will depend on how easily you can convince the court that you are able to support yourself. Since you do not have a job, that's likely to be an extremely long process.

    You might do better for your parents to give a relative or friend in the area temporary guardianship of you so that your guardians can enroll you in school. That is going to be a much shorter process, and, quite frankly, much more likely to happen. Even WITH your parents' permission and approval, emancipation is by no means guaranteed to occur.
