My question involves divorce in the State of: VA
I recently was made aware that my mother is a a lesbian and had had an extended affair with a friend of hers. She has since come out to my father and told him that she wants a divorce. I have a few questions about her future:
1) what will she be entitled to? I have a friend who told me she will get nothing as she cheated, though she is a career military wife therefore she was unable to pursue her career based on moving frequently for my father, though she does have her B.A. in Education.
2) Will they be able to get an annulment? This is her goal for my fathers sake as he is really religious and she does not want to strip him of the sacrament of communion(don't get me started on the psychosis of the Catholic church)so she wants to get it for his sake on the grounds of "fraud" on her part. My confusion on this arises from other forums I have read that if they do not divorce immediately when the other spouse is made aware, than the "differences are reconciled" in the eyes of the state. However, they are waiting to file until my youngest sister graduates HS in 3 more years, (and my father has already known for a year)
3) Will they have to get separated first (they are currently in counseling per my fathers request) once my little sister graduates? Or will they be able to get the Annulment/ Divorce right away?
Any advice you can give me would be greatly appreciated, as I am very concerned about my mothers future, and whether I need to plan to be able to support her financially, or if in your opinion she will fair alright through the divorce/ annulment ?
