    Default Sex offender's failure to register - Statute of Limitations

    What is the statute of limitations in Iowa for sex offender failure to register? (aggrivated misdemeanor)

    I had an indecent exposure 1st offense to 17 yo and so must register.

    Police claim I set up residence in IA for more than 5 days and so I should've registered. I have evidence (bank, restraunt reciepts) to show I was 300 miles away.

    cops got an idiot judge to sign off on a warrant

    Default Iowa Aggravated Misdemeanor

    I understand an Iowa aggravated misdemeanor to be punishable by up to 2 years in prison and/or a fine of up to $5,000.

    Default SOR statute of limitations

    so the penalty is REALLY severe. What do you think the statute of limitations would be? 1 yr? 3? or ???

    In all cases, except those enumerated in sections 802.1 , 802.2 , and 802.2A , an indictment or information for a felony or aggravated or serious misdemeanor shall be found within three years after its commission.

    Default statute of limitaions

    SO if a judge signed off and a warrant was issued, is that an indictment?


    since I live outside the state of Iowa, my plan was to
    just wait out the warrant until the statute of limitations expires.

    If the warrant is the same as an indictment, will the warrant ever expire?

    Other than facing the legal system, posting bond, going to court, trial.... AND the EXPENSE of a lawyer, is there another planto get rid of the warrant?

    Or will this warrant always hang over my head until I get stopped for a traffic ticket, and they run my license and find the warrant?

    Thank you for your speedy replies. If I would have been more clear with my questions, this wouldn't be taking so much of your time.

    Ordinarily, yes. And the statute of limitations stops running at that point.

    X. Sex Offender Registry.
    Registration. A person who has been convicted of certain sexually related criminal offenses is required to register as a sexual offender with the sheriff of the county of the person's residence.158 A person must register within five days of a conviction for which the person is not placed in confinement, or within five days of being released from custody.159 A person who is required to register must also reregister within five days of changing residence or within five days of changing the person's name.160 A person must also notify the sheriff of the county of residence if the person moves out of state and register in that new state if that state requires sex offenders to register.161

    Penalties. A person who knowingly fails to comply with any registration requirements commits an aggravated misdemeanor for a first offense and a class "D" felony for any second or subsequent offense.162 A person who knowingly fails to comply with any registration requirements and subsequently commits a sexually related criminal offense commits a class "C" felony.163 The Iowa Supreme Court has concluded that registering for the Sex Offender Registry does not violate the Ex Post Facto Clause of the federal and state constitutions.164
