If she's living there, she's a tenant and has legal rights, lease or no lease.
Sue her for the amounts she owes.-she has been behind up to 2 months at a time in rent and has never paid some utilities
Sue her for the cost to restore the damage. Get photographs and keep receipts.-trashing her part of the apartment and common areas

-she has told me that she cannot be out till March (likely the end) and I know if I give her that long she will continue to drag her feet
