    Default Landlord gave the key to someone not on the lease

    My mom moved to an apartment to get away from an abusive ex. He found out where she was living and told the assistant manager he locked himself out and he gave him the key to let himself in. while he did stand at the bottom of the steps to get the key back right away, he didn't notice or care that he was also unlocking the deadbolt, that my mom had locked out of fear because he was pounding on the door earlier. If you lock yourself out, how did you lock the deadbolt?

    Now my mom is having problems with the manager because her money order got dropped in the rain and they won't accept it and it will take 30 days to get a refund from the money order company. It clearly says the amount, and who it is written out to. I am not saying they should accept it, but shouldn't they be a little more flexible with my mom after what they put her through? I feel she is being treated unfairly and am also wonder if she has a case against these jerks. My mom could have been killed and I am scared for her safety.

    Because of this ex, her credit is terrible and she can't just move somewhere else so she needs to stay there until she can find a way to move somewhere else.

    Can anyone tell me if what the managers did was illegal? I know in Oregon, when the manager enters your apartment without notice it is worth one month's rent (this happened to me and i won) but what is it worth when a psycho ex is GIVEN the key and allowed in when not on the lease? They hadn't even seen him before!

    Any info is much appreciated!

    Default Landlord Problems

    Obviously the landlord shouldn't be giving non-tenants access to an apartment. It is not apparent from your story whether any harm resulted.

    The issue of rent payment is separate. Perhaps you can intervene with the money order company, to see if they can expedite reissuance, or in the alternative loan your mother her rent money so she can pay her landlord.

    Yes there was harm, no she wasn't murdered. I think the point is that the managers were in the wrong, not how much harm was done.

    When I took my landlord to court for entering my apartment without permission I was granted one month rent and more for other reasons.

    My mom didn't do anything about this incident because she didn't want any hard feelings. Well now they are being jerks I think she should have hard feelings. My question is does she have a case against them for giving the key to someone not on the lease. She can't sleep at night because she is scared it will happen again. Nobody should live like this.
