My question involves emancipation laws for the State of: Florida.
Okay, my situation is actually a bit complicated. No, I'm not your typical teenager trying to get away from their parents just because I don't like them or because I want to move out and do whatever I want, etc.
I'm 16 years old living in the state of Florida. July 17th, 2008 I was removed from my only parent, my biological and legal guardian; my mother and taken into the 'temporary' custody of the State, ChildNet. (CPS removed me from the home) As of right now, I'm still considered in temporary custody of the state. I was removed due to my mom being mentally unstable as well as financially. She is now homeless at the moment. Despite the fact that I'm in ChildNets custody, I have been a chronic/habitual runaway from the start, always coming and going.
I was recently pregnant and got a Judicial Bypass to get an abortion which was completed this past Friday. I know that being pregnant does not mean instant emancipation and I am aware that the only way I may be emancipated are if I were to marry, get the court to approve it, or of course turn 18. The reason I'm mentioning the pregnancy is because several clinics recommended I "Declare myself an independent" because of my situation and how much difficulty I had getting what I needed to get the abortion (again, because of my current situation) but I doubt the fact that I was pregnant has any influence on whether I can be emancipated or not.
I've been living with my friend, steady for about 2 months now and am really frustrated trying to get my own documents (Birth certificate, social security card, etc.) in order to get myself an ID. I need an ID to acquire a job and to enroll myself into GED classes/school which now that the abortion is out of the way will be my next focus and task. It is my understanding that in order to get emancipated I would need to have to have a steady job and possibly be in school.? However, I can do neither at the moment due to lack of an ID. It is all very frustrating. I also cannot make myself appropriate doctor appointments like I need to (dentist, physician, etc.) which I'm also concerned about and would like to do.
My mother whom I spoke with today via cellphone talked with me about getting emancipated and she would have no problem with it. However, I don't know considering I'm in temporary custody of the state if her input matters. I do not have a Guardian Ad Litem currently which I do not understand since ChildNet should have appointed me one months ago and I do know that my mother is my only legal parent, my biological father is deceased.
I'm honestly not sure what to do in my situation but I'm trying to take care of myself the best I can (with the help of my friend and her parents. They provide shelter, shower and most food for me) and really believe that getting emancipated would be in my best interest.
I also know that I should be receiving SSI through my mom for myself which is supposed to be going to ChildNet but according to them is not, and my mother tells me when I'm 17 I can receive the SSI myself. If I were emancipated would I still have to be 17 to do this?
Sorry for such a long post and so many questions. I just wanted to explain my situation as detailed as possible but without getting too much off topic because I have A LOT going on and a few of those things mentioned could probably be posted in a different category. =X I'd appreciate any help or information I can get.
