I know this topic come up many times, Ive been sorting through them, but can not seem to find a near solution besides a lawyer.
I am a US Citizen, and married abroad. She got her conditional green card four months after her arrival, and then we started having problems (arguing), and her not being able to understand life in America.
Eight months later we are separated, and are now filing for a divorce.
I wanted a divorce or separation(twice) a few months before, but she would tell me things like she is going to commit suicide, or never get married again (trying to angle a love relationship into it). At one time she even grabbed a knife and walked out side, i did not chase her or follow her. I called my family and told them about the situation, and left my home for the evening leaving her alone in the house. I accepted her apology on many occasions, just to run into the same situation again.
The third time I told her I wanted a divorce she called 911 and claimed that I abused her. Although I never touched her, the police did not take any action on me, because there was no evidence of abuse. Instead they took her and placed her in a nearby hotel. The police report stated that she was mentally and physically abused by my family and I.
I do not have physical proof that she may came out here for green card purposes, but she did open up her own bank account and with held ALL information of it from me. She wouldn't give me a proper schedule of her her (since i was the primary driver for her to and from work), and she direct deposited ALL income into this account. Every time I would inquire about this we would end up arguing, and she would walk far from our living quarters to make phone calls on her cell phone.
would that count as evidence as possible fraud, or planning to abandon a marriage?
after living with her for 1 year and 3 months I feel as though I am the one one who was mentally and physically abused. I was the the one taking care of all financial burdens, (even though she worked).
What can I do, now that she has her conditional green card?, and has already filed for a divorce.
what are the benefits of her filing first vs. me filing first?
Is there ANY POSSIBLE way that I can report this type of incident to USCIS, or ICE or any other service, so when her permanent residency interview comes up, they can at least review her past history before granting her a permanent residence card.
