    Default Changing Minors Last Name

    My question involves name change laws in the State of: california

    The father and i were never married. My daughter now 1 1/2 . The father (and his mother) told me when my daughter was born that i had to give her his last name, and then the father (influenced by his mother) refused to have his name on the b-certificate as the father. Can i have his name removed but if not, can i add my last name so it read dads name then my name. He has not signed papers of paternity but the courts gave him 50/50 custody. after a year of back and forth court hearings and lawyers that did not help i mentioned to the judge that he has not signed papers of paternity, the judge did not care and said , so serve him!. The father wants all the rights but none of the responsibilities.

    From what you say, he's been adjudicated the child's father. If you want to change the child's name, you need his consent or you need to prove to a court that the name change will be in the child's best interest. He's entitled to notice of any name change petition, and may oppose the petition.
