    Default Marriage Fraud and Annulment

    My husband was on a Tourist VISA when we were married... a couple of days before his VISA expired. It took me a couple of weeks to gather my belongings and furniture from my sons' house before I could move into our apt. in which a mutual friend (childhood friend of my husband's) signed the lease --- I am in-between jobs.

    Third week our marriage was consummated. During the next 2 weeks, husband complained about the expense of the apt. and food. Then he took both Marriage Certificates from me and said he was going to file for divorce. Also, after our marriage he tells me that he married me strictly for business and sex. I married for companionship ... we are both in our mid fifties.

    In the beginning, I was researching how to file for petition for him but he was always vague on getting the copies of needed divorce papers, etc.

    I left the apt. when he said he wanted a divorce. He said I could come back on 2 conditions: (1) no sex within or outside our marriage and he did not want me to touch him (guess hugs) nor see me naked; and, (2) quit smoking (he knew I smoked before we married).

    I want an anullment. Can he use our Marriage Certificate illegally - such as getting a job, etc? I don't want to be involved in anything wrong, but haven't any money to file, yet. Our mutual friend has since moved in with my husband and has ordered that I take my stuff -- and my family does not help me to move and I have no funds.

    My stuff is still at the apt. and I am so afraid that I will lose everything.

    Default Divorce or Annulment

    If he married you for fraudulent purposes to advance his immigration status, the BCIS would probably respond to any actual divorce. It is not illegal for him to represent himself as your husband at present, as you are in fact married. You probably do not qualify for an annulment, but you may wish to discuss that option with a local divorce lawyer.

    Thank you. This has helped to relieve my mind .. somewhat.

    Yes, I do understand that each state is different when it comes to Annulments --- but have not yet had the funds to even consult a lawyer but shortly this is in the progress of change.



    I did not have the funds to even consult a lawyer, much less hire one, and now, that I will be able to shortly improve this situation the question of having some sort of time deadline popped up in my head: :?: Is there a deadline for filing for an annulment should I be so lucky in getting an annulment as opposed to divorce? I plan on suing.

    We provide information on annulment law in the linked article.

    You can probably buy a "how to handle your own divorce"-type book at a local Borders or Barnes and Noble, complete with forms for your state, and you can probably navigate your way through a simple divorce for the cost of the book, filing fees, and office supplies.
