My question involves a traffic accident in the State of: Alabama
Accident was in a subdivision with unmarked lanes. Traveling north, had entered the road about 50-100 yards from a stop sign. Vehicle turns from a stop sign (not sure if they stopped or not) onto this road going south. They swung wide and we collided. They say I was in their lane; I don't think I was. With the road being unmarked, I can not say for sure that I was completely to the right side of the road but I know I was not blantantly in their lane. I have been told by several people that even if I was not totally in my lane, I had right of way and they should not have entered the road. But the adjuster says that only applies if both are traveling in the same direction. In the pictures, my car is toward the middle of the road but more on my side. His car is back over in the grass by the stop sign as if the wheels were still turned upon impact and he just rolled backwards in a curving motion. The impact was my front driver corner and his center with the damage going toward the driver side. I passed out and was carried to the hospital so I remember very little. My insurance company is saying it is word versus word and they are waiting on the poilce report which is done on what he said so that really bothers me.
