    Default Public Intox Charge (Under 21)

    My question involves criminal law for the state of: Virginia


    A couple weekends ago, I got arrested for being drunk in public & I'm hoping for some good defenses for my case (if any). I honestly don't even remember anything from being in the dorm room to regaining consciousness in a detox cell, but what I'm saying is what my friends told me happened that night.
    We were celebrating my friends' birthdays & some of us got more drunk than others... apparently I was supporting my friend all night because she was acting belligerent, but we both fell to the ground right before our campus cadets started towards us. I was being questioned the entire time, I guess because I was clearly more drunk... but long story short, the cadets ended up calling the real police officers... I blew a .26... I told a cop to back the f*ck up when he first came up to me (which is very out of character for me, I'm deathly afraid of cops & would never say that!..sober).
    I just turned 19 years old so I'm obviously underaged. My court date is about a month away & I'm very scared to see what's going to happen. If anyone can help me with any defense at all, that would be great.

    What defense were you thinking about bringing forward?

    You can't say you weren't drunk. You can't say you weren't obviously and publicly drunk.

    What angle are you looking to achieve?

    Anything at all?

    I was obviously drunk, but my friend said I should still look up defenses online. Should I just plead guilty?

    I would recommend getting an attorney.

    The attorney will help you to get diversion or some other program so that, once your probationary terms are satisfied, this will drop from your record.

    You yelled drunkenly at a cop and have no real memory of the events of the night. You really cannot testify with any credibility as to what did or did not happen.

    That limits your options.

    hm yeah when i say that i told a cop to back the **** up, it was moreso a mumbling. i didn't yell at him
