    Default Lying to Police Officer

    My question involves criminal law for the state of: California

    I was arrested for driving with possession of marijuana. So let me run the story down to you to see if I was treated in such a manner that might make this case go away.

    I was pulled over for making a bad turn. Apparently the officer smelled pot in the car. He asked if he could search my car or if I had any drugs on me, but I refused and said no. However, after that he said he could smell the pot. Then I let him know that I did have a small amount (which was less than a gram). He then arrested me and I was charged for VC 23222 (b). So basically, I lied to him, then confessed without him finding it via search.

    Now I read that this (vc 23222) is punishable by citation without booking, however I was booked. Is lying to a police officer grounds for making a legitimate arrest? I was not charged with anything but driving in possession. I should have told him I was just joking!

    Now, I am no master of the law, but it's nice to think he either let me off pretty easy (by not citing me with the illegal turn and lying to him) and its even nicer to think that he was having some sort of crazy ego trip and that I have a chance it making this whole case appear as if it never happened.

    I'm not sure what you're trying to ask. You're wondering if you can somehow be "unbooked"?
