    Default Friend Shoplifted, I Was with Him but I Didn't Know

    I went to the local shopping center to pick up a game. Me and my two friends went into FYE ( For Your Entertainment ). One of my friends brought his two cousins along that lived somewhere in long island, but that isn't important.

    After five minutes in the store, the four of us found out that the shoplifter was caught. Instead of running away, he said he was sorry, and the manager decided to let him pay the amount of the CD he stolen. He asked me for money, which i gave him to pay it back, without hestation, and the manager came upto the rest of us after and said to the security guard

    "This one *pointing to one of the cousins* was helping this kid not get spotted, this kid *pointing to the other cousin who was looking at CD's on the other side of the store* was blocking the camera" He didn't mention anything about me or my other friend. Me and my friend were looking at the Video games on the other side of the store.

    The security guard asked for our identification which me and my friend didn't have, but the shoplifter and one of the cousins did. He asked us for our ages, I said I was 15 not only because I am, but because this has happened before where the most unlikely person in our group shoplifted from the same store.

    The security guard told us to stay put and he would be right back so we waited, trying not to cause any trouble, when the security guard comes back with the manager and the manager says " You should just take them all, they all are probably thieves."

    I got pissed off. I didn't say anything, but all of us besides the shoplifter were let off the hook.

    Only thing is , he banned us from ever coming back to the store, when we didn't even know he was trying to steal.

    I've been going to this store for the past 5 years, and this incident has happened before, in which i was with another person who stole something, and the manager even commented " I seen this kid before, he's a good guy" ( to me ) but I feel really angry right now.

    I really hate the law. It's like even if you didn't do anything or are innocent, these bastards just want you out of their life.

    I really liked that store

    It is their property. They can control it as they desire.

    Maybe you should find some friends that don't steal. Since this is the second time this has happened to you, your choice of friends would be somewhat suspect. Ever hear the old adage: birds of a feather flock together? If you remain in the same "flock" you will often be considered suspect.

    I forgot to add the question to the thread though.

    Since I live in NY, and I take law class in school, I know that if someone were to shoplift, they wouldn't be charged with it until they left the store. The shoplifter did not leave the store, but still they the security wanted to search him and whatnot.

    He said that he knew his rights and that he did not break the law, he only damaged the merchandise, payed it off, and said he does not consent to any searches, yet they searched him and demanded his information.

    Isn't this illegal?

    since you take a class in school, you should be somewhat familiar with researching your states laws. I would suggest you are incorrect in your assumption that the thief has to leave the store before apprehended. Many states simply require "intent" to make the charges. There mere act of concealing the merchandise is enough in many states. I'll let you research your states statutes to confirm or rebut my claim.

    he "broke" the merchandise? as in broke the case the cd was in? That is most definitely intent.

    Since he mentioned Long Island, I am guessing NY.
