My question involves landlord-tenant law in the State of: California
I had a written lease that expired on March 14, 2008, I verbally agreed to extend the lease to March 14, 2009. On January 20 I sent written notice and followed up with a phone call that I will be not renewing the lease and they need to be out by March 14, 2009. I also told them if they plan on moving out early they need to give 30 days notice.
I called the tenants on February 20th asking for the rent,due on the 15th. I was asked if I received the letter from them. I never received a letter stating the are moving out early. I just inspected the property and no one is living there but there is a bunch of personal property and a car in the garage and the place has not been cleaned in 2 years. I have not received keys back either.
My question is do I need to proceed with eviction procedures or can I just call the place abandoned and have the personal property removed?
I would notify the old tenants of my plans and give them an opportunity to move the rest of the stuff out.
This place will be my primary residence again and I need to move in as soon as possible due to economic hardship.
