    Default Florida Emancipation-Change of Custody

    My question involves emancipation laws for the State of: Florida

    My son is 16 and lives in Florida. His father and I have joint custody, but his father now has 'residential' custody. My son wants to file for emancipation so he can move out of state to live with me (Florida does not have and age where a child can pick which parent he wants to live with). I have 2 houses, 1 on which he could live in with no charge and we have a family business he could work in for income. He would complete High School here. I would just file for change of custody but he would only tie it up in court for months and months like he did before. His father works 4 hours away from him and is only home on weekends, so he is basically raising himself. He is an above average student, and has never been in any trouble. Any advice? Thanks

    If you want him to live with you, file for custody.

    Both parents have to agree to be emancipated in Florida, and without a job and a self sufficient place to live ("gonna gets" and "should haves" don't go far), he doesn't have a chance.

    Especially when the court will see that this is a transparent attempt by you to bypass the courts previous custody order.
