    Default Vilolation for Suspended License

    My question involves criminal law for the state of: Florida

    I am currently on state probation. I always report on time and follow all my PO's orders. I just got pulled over and found out that my license was suspended. I was given a criminal traffic citation. The officer said seh believed me that I didnt know so she didnt arrest me. Now, does my PO have to violate me or is it at his discretion? Thanks.

    You need to get ahold of the DMV to see why you are suspended. However, I can't imagine it was an error at the DMV level. In which case, your "I didn't know" defense is useless. Your best bet is to try to get the offense knocked down to something non-criminal so that you don't face a probation violation. Clear up whatever it is prior to the court date and show the court that you did the right hing. Normally, you can get a lesser charge of dismissed with court costs type of finding.

    It is suspended. I was released from jail 2 months ago. I did 6 months. I was never notified about the suspension. Thank you.

    You were notified. You just never received it. Still, it is no defense to say that you were never notified because ultimately it is your responsibility to know the law. Is it a timed suspension or is it just pending payment of something?

    I am not trying to make excuses. I was incarcerated in a different couty than I live. I think the suspension is for non payment of court costs. What ever it is I justdont want to violate probation. Thank you

    Call the DMV and they will tell you how to clear it up. Mke sure you pay the Court's money to the Court but alos pay a reinstatement fee to the DMV. A lot of people figure that just paying the fines to the court clears the matter up. It doesn't. You will still have to reinstate your right to operte w/ the DMV. I'd leave it to a lawyer or Law student to guide you on the probation part. If you notify your PO of this, you run the risk that maybe you let the cat out of the bag and she may not have found out otherwise. But you also don't want to seem like you're trying to hide something. Tough choice here. First and foremost though, the fact that you took care of it is going to look good for you.
