    Default Name Change for Child - I Am the Only Parent on Birth Certificate

    My question involves name change laws in the State of: TX

    My son's last name is hyphenated. I am wanting to remove one of his last names. I am the only parent on the birth certificate since his father refused to have his name put on the birth certificate. What is the likelihood that I can do this without having to deal with his father?

    Little to none.

    Although he is not named on the birth certificate, you will still require his cooperation - or at the very least, notify him - in order to proceed with the petition.

    You can get all of the proper forms, including those you need to notify him - from your county Clerk of Courts.
